I'm sure this has been covered somewhere but I can't find it. Sorry if I'm asking a duplicate question. I'm pretty certain that song titles can't be copyrighted, isn't that right? It's only the actual content that's copyrighted? I know I've heard of more than one song with the same title (don't ask me for examples, I can't think of any at the moment!) I just wanted to check.
"And if you don't know where you're going, any road will take you there." -- George Harrison
Song titles are noncopyrightable (as well as titles of books, movies, etc). Obviously, if two songs share the same title, the music and the lyrics must be different.
One possible exception...if an existing song has a title that has become so well known as to have "secondary meaning," then you'll probaby want to avoid using the same title, as unfair competition could come into play.
